Tim Short Honda sold us a car with frame damage

We recently had our Chevrolet Colorado that we purchased from Tim Short Honda in the shop to get the suspension checked. As soon as they put it on the rack the mechanic called me to come back and look at it. The frame had so much rust damage that the leaf spring had fallen out. The mechanic advised I drive it home and nowhere else because it was very dangerous to drive like this. There is no way the frame got in this condition in the 10 months we had it, it was sold to us this way from Tim Short Honda and as far as I know it's illegal to sell a vehicle with frame damage without giving written notice of the damage. Needless to say we weren't given written notice. I called Tim Short Honda the day after they uncovered the damage and explained the situation to the sales manager and asked if there was anything he could do. He said that's the thing with used vehicles, you bought it as is, etc. I said yes but selling one with frame damage is a different matter because it's illegal if you don't give written notice of the damage, he responded "With us having prior knowledge." He said he didn't think he could do anything for me so I said Okay and hung up. Got a message from the salesman 10 minutes later asking if we'd be willing to trade it in on another truck, I asked what he could give me on a trade in, he said he would see what they could do and I haven't heard from them since. So right now I have a vehicle that Tim Short Honda sold me that could possibly kill me but I still owe 6,600 dollars on it. Now I understand if it was a motor or a transmission that needed to be replaced, that's life and there is a solution to those problems but frame damage around the suspension is another issue completely. So were stuck in a point whether we should take legal action or pursue some other avenue.

They Sold Me A Vehicle With Frame Damage

I bought an 2005 Chevrolet Colorado from them in November. We just had it in the shop to have the suspension checked. Mechanic called me back to come look at it as soon as they put it on the rack. There was so much rust damage to the frame that the leaf spring had came out. He told me that it was very unsafe to drive and that it would be best to drive it home and nowhere else. Welders don't want to touch it because it's a liability. I contacted them about it and explained the situation, seemed pretty indifferent about it, told me there wasn't anything they could do. Got a message asking if I was interested in trading for a different vehicle, I asked what they could do on trade in and was told by the salesman that they would see what they could come up with but haven't heard anything in a week. I'd understand if it was the motor, transmission or anything like that went bad, it's used and As/Is but selling a vehicle with frame damage without giving written notice is illegal and potentially deadly. So basically been risking our lives for over 10 months driving a vehicle sold to us by Tim Short Honda in Ivel Kentucky.

Excellent service. Nathan the salesman, Nathan the mechanic and David in the financial dept. were particularly helpful. The car was delivered to my home within 90 min. of the purchase and I signed for it on my kitchen table! That's a first! Many thanks!1
